This website is operated by Botines Charros LLC. Throughout the site, the terms "we," "us," and "our" refer to Botines Charros LLC. We offer this website, including all information, tools, and services available on it, conditioned on your acceptance of the terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing from us, you agree to be bound by these Terms of Service. They apply to all users of the site, including browsers, vendors, customers, and content contributors.

Please read carefully before using the site. If you do not agree to these terms, you may not access or use the services. We reserve the right to modify these Terms and post the changes on this page; your continued use of the site constitutes your acceptance of them.

Our store is hosted on Shopify Inc., which provides us with the e-commerce platform.

1. Store terms

You represent that you are of legal age or have the consent of a responsible adult to use this site. You may not use our products for any illegal purpose or violate any laws in your jurisdiction. Transmitting viruses or malicious code is prohibited. Any violation will result in immediate termination of service.

2. General conditions

We reserve the right to refuse service to anyone at any time. Your content (excluding card information) may be transferred unencrypted over networks. Card information is always encrypted. You may not reproduce or exploit the service without our written consent.

3. Information on the site

We do not guarantee that all information is accurate, complete, or current. It may contain historical or outdated information. It is your responsibility to monitor changes.

4. Modifications and prices

Prices may change without notice. We may modify or discontinue the service at any time without liability to you or any third party.

5. Products and services

Some products are available only online, in limited quantities. Returns apply only in accordance with our Returns Policy (see section 20). We do not guarantee that the colors displayed on your screen accurately reflect the actual product.

We reserve the right to limit sales by person or region. We may change or discontinue products without notice.

6. Billing and accounts

We reserve the right to refuse orders or limit quantities. If changes are made, we will attempt to notify you. You must provide truthful and current information. See our Returns Policy.

7. Optional tools

We may provide third-party tools "as is," without warranties. Your use of them is at your own risk.

8. Third-party links

Our site may contain links to external sites. We are not responsible for the content or services offered by third parties. Review their policies before making any transaction.

9. Comments and feedback

You agree that we may use your comments without restriction. We reserve the right to edit or remove content that is offensive or infringes third-party rights.

10. Personal information

The use of your personal information is governed by our Privacy Policy.

11. Errors and omissions

There may be typographical errors or inaccuracies. We reserve the right to correct them at any time without prior notice.

12. Prohibited uses

You may not use the site for illegal activities, rights violations, harassment, sending viruses, impersonation, spam, etc. We may suspend your access for violating these rules.

13. Limitation of liability

We do not guarantee that the service will be uninterrupted or error-free. You agree to use it at your own risk. Botines Charros LLC is not liable for indirect or incidental damages. See section 20 for notes on natural materials.

14. Indemnification

You agree to indemnify Botines Charros LLC against claims arising from your breach of these terms or violation of any law.

15. Severability

If any provision is found invalid, it will not affect the remaining provisions.

16. Termination

Either party may terminate this agreement. If you breach these terms, we may cancel your access without prior notice.

17. Entire agreement

These terms constitute the entire agreement between you and Botines Charros LLC.

18. Governing law

This agreement is governed by the laws of the State of California, USA. (See also section 20.)

19. Changes to these terms

We reserve the right to modify these terms. We will post changes on this page and notify you if they are substantial.

20. Returns policy and special conditions

• The return period is 30 days. The item must be unused and in its original packaging.
• We do not accept returns of used items, or of Final Sale, Flash Sale, or Botines Vaqueros Sorpresa items, except for manufacturing defects or shipping errors.
• On every order, the first exchange for a different size or style is free: Botines Charros covers the return shipping and the shipping of the new item. If the new style costs more, the customer pays the difference; if it costs less, the difference is issued as store credit.
• From the second exchange on the same order, the customer covers both shipments. Diamond-tier members get unlimited free exchanges, with both shipments included.
• The free exchange does not apply to discounted items; in those cases, the customer covers both shipments.
• For returns with a refund, including discounted items, Botines Charros covers the return shipping.
• Botines Charros also covers shipping when there is a manufacturing defect or an error on our part.
• Products made with natural leather may show variations in color or texture. These are not considered defects.

Exchanges or returns apply if:

• The item has manufacturing defects (broken zippers, missing embellishments, broken buckles).
• You received the wrong item with no signs of use.
• The item didn't work out in size, color, or style and is in perfect condition, with no signs of use, and in its original packaging.

Exchanges or returns do not apply to:

• Items with signs of use (scuffs, stains, worn soles, marks on the leather).
• Damage caused by misuse, liquids, fire, or non-recommended conditions.
• Natural wear from use.

About deer leather:

• Deer leather is soft and delicate and can scratch with use or friction. These marks are not manufacturing defects or grounds for a return.
• The warranty does not cover damage from misuse or natural wear, even within the stated period.

21. Intellectual property and content

Unless otherwise stated, all site content is owned by third parties or licensed to Botines Charros LLC. It may be shared only if its image is not altered and it is not used for malicious purposes.

22. Payment methods and security

We accept Visa, Mastercard, PayPal, Apple Pay, Google Pay, and Shop Pay. Transactions are protected by SSL encryption through Shopify Payments.

23. Express consent

During checkout, you must expressly accept our Terms of Service, Privacy Policy, and Returns Policy by checking a required box.

24. Loyalty program

Botines Charros offers a free loyalty program with five tiers: Bronze, Silver, Gold, Platinum, and Diamond. To participate, you must create an account and sign in. By participating, you accept its conditions and future changes.

How points are earned. Points are earned at the time of purchase, at a base rate of 1 point per $1 USD spent; higher tiers earn more points per dollar, according to the tier table. Points are earned and redeemed equally online and in physical stores; in store, you must provide your account email at checkout. Points accrue only after you register: purchases made before creating an account do not earn points. Amounts with cents are rounded down to the nearest whole point.

In addition to purchases, points are awarded for the following actions: joining the program (200 points), product review (20 points), review with photo (30 points), review with video (40 points), and following Botines Charros on Instagram (20 points).

Tiers. You move up a tier based on your cumulative spend. The number of purchases does not count toward tier advancement.

• Bronze: create an account. 1 point per $1 USD and early access to new products.
• Silver: spend $1,500 USD. 1.1 points per $1 USD and a $50 USD welcome credit coupon.
• Gold: spend $3,000 USD. 1.2 points per $1 USD and a $100 USD welcome coupon.
• Platinum: spend $5,000 USD. 1.3 points per $1 USD and a $200 USD welcome coupon.
• Diamond: spend $15,000 USD. 1.6 points per $1 USD, a $1,000 USD welcome coupon, access to presales, and invitations to exclusive events.

Tier welcome coupon. Granted only once, upon first reaching each tier; it is not recurring. It is personal and non-transferable, single-use, and valid for one year from issuance. Each coupon requires a minimum purchase: $150 USD for the $50 coupon, $300 USD for the $100 coupon, $600 USD for the $200 coupon, and $1,500 USD for the $1,000 coupon. If a member qualifies directly for a higher tier, only that tier's coupon is granted; coupons for intermediate tiers are not issued.

Tier application and retention. A tier change may take up to 30 days to apply after it is reached, during which we verify that the purchases that earned it are not returned. Your tier is not lost due to inactivity or if you stop purchasing. The tier is kept as long as the member meets the current spend amount for that tier; if Botines Charros changes the required amounts, tiers are recalculated based on the current amounts. A tier may also be adjusted when a return puts the member below the required amount.

Birthday gift. On their birthday, members who have registered their date of birth receive 200 points, notified by email.

Redemption. Points are redeemed at checkout by selecting the amount to use, up to a maximum of 20,000 points per purchase. The rate is 100 points = $5 USD and stays proportional. You must be signed in to redeem. Points discounts cannot be combined with other promotions. Redeeming a gift product requires at least one paid product in the cart.

Expiration. Points remain valid as long as there is activity on the account: any purchase resets the validity of all points for 12 months. An in-store purchase resets validity as long as the account email is provided. Points are non-transferable and have no cash value. If the account is deleted, the points are lost.

Returns and points. If a purchase is refunded, the points earned on that purchase are adjusted or removed, regardless of whether the refund is in cash or store credit. For partial refunds, points are recalculated based on the amount actually paid. If the points had already been redeemed, the balance may be temporarily negative until the next purchase.

Botines Charros reserves the right to suspend accounts for misuse or fraud. The program may be modified or canceled at any time. Updates will be posted on the program page and communicated by email and text message.
